My former employe sent documents to employees which contained my name, ssn, and 401k balance. Can I sue them?

When an employee requested benefit plan information this employer sent information which contained my name, social security information and 401K information for employees who left the company in that year. Please note this breach occured during 2003-2004 and I was just notified. The employer is Northwestern Mutual Life Insurance.

Consult an Atty. In the Age of Identity theft, release of personal information to unauthorized parties is a serious matter. And statutes of Limitations don't start ticking until you are notified or otherwise discover the breach.

Unless, you have suffered damages, you might not be able to file a Civil Action, but there may be Criminal Charges you can file. That's why you need to consult a Specialist in Business Law.

You most certainly can!!! Get a very good attorney and sue the hell out of that company.

You can only sue if you incurred a loss or you were injured because of this action.

you can but you won't win. Especially if it was done in the normal course of business. You didn't say what the positiion of the employee requesting the information...So I couldn't even begin to tell you if it was normal course of business.
