Question

Asked 2/6/2008

When filing 'married filing seperately' is one spouse responsible for the taxes owed or filing errors of the other spouse?

I am currently seperated from my spoue. He has withdrawn a large amount of his retirement funds without having any taxes taken out of that money. He also has earned approx. $2,200 additional income that he tells me he won't get a 1099 on which had no taxes taken out of it. If I file seperately what kind of obligation am I under to pay taxes on the funds he withdrew, and the moneies which he is considering not reporting? We are still married.

He will be responsible for his, and you yours. This type of filing is set up for married people who are seperate and no longer maintain a home, bank account, etc.. together.
