What are my legal rights to what I would be entitled too! My husband and I have been married for 12yrs have no children. Through the course of our marriage my husband has had several affairs! He asked me to forgive him which through counseling together I choose to do that. We are currently living in Maryland and my husband is getting ready to retire from the military August 7, 2011 after serving 23yrs in the Marine Corp. We planned on moving back to my home town Southern California. Just recently my husband said once he retires he is not going to move to California with me and now wants a divorce. I am crushed to say the least. We have mutual funds together, he has IRA and I have my 401k from my past and current employment. He also does get his military retirement which he says I am not entitled to plus I will loose my health insurance through the military ..Is any of this true? I dont know what I will be entitled to or what my rights are at this point. Any help would be greatly appreciated! |

Well, you didn't serve in the military (although I know the pain of being married into it also). My sister got divorced from her military man and she no longer had the health insurance. At this point, I think it's best to get out of the bad situation.
Unless you have a horrible illness and absolutely won't live without that insurance, I think it's best to find a way to leave. If you are slightly unhealthy, you can work on disease prevention which would do wonders at keeping you from going to the doctor.
As for the rest of it, I don't know how much you can get. My sister didn't fight to get monetary support. All I know is that the health care was taken from her.

In nov, 2006, my fiance was divorced. in the agreement, his now ex wife had 10 days to file for her share of his 401k, as stated in the divorce decree. she never did that, and now wants to do so. is she still entitled to the money ($3,000)?
