Taking money from mentally handicapped In oklahoma, is there a law concerning taking money from a retarded person who seems perfectly willing to give it? the retarded person is my nephew with no legal guardian. he is very mildly retarded and had worked for the pepsi company for almost 30 years before getting fired for actions attributed to this drug taking "girlfriend". she continues to take all money he has,even his 401k money. he always gets down to nothing, not even a change of underwear, then comes back to my 75 year old sister long enough to get started again financially then the girl shows up and nephew is willing to go back with her and the process begins over again. i understan that the girl screams in his face but don't know if she threatens him physically or not; however she runs with scarey characters because i have seen some of them a couple of times. i do know "heresay from nephew" that she will find drugs and tell the seller that nephew will pay for it. i am at a loss..am concerned for safety of sister, brother-in-law And nephew. |

I'd go talk to someone in social services about this. It seems like someone needs to intervene. I don' t know if the police will unless he makes a complaint though. Does he have a guardian of any kind? Maybe you need to introduce him to some new women so he'll dump the girlfriend. That might be the least confrontational way to handle it. You could also call your division of The ARC, they handle all kinds of issues for the mentally handicapped and I'm sure have run into this problem before. Having a daughter who is in the same situation mentally and who would give away the world, I feel for you. We've set up staff to come in and review her expenditures, and did this through social services. We're hoping she'll learn enough so that by the time we're not around anymore in twenty or thirty years she'll be ok, but if we have any inkling she won't be we'll set up a financial guardian. I'm not sure how willing you are to get involved knee deep in his 'issues' so its hard to give advice.
