Question

Asked 12/12/2007

My father passed 12/6/07. I am his only child and only living relative. He did not own a house. The total of his monies is around $38,000.

His life insurance policy is $6,500 and not even what I spent for a basic ceremony. I am unemployed. I want to sell his furniture and donate his clothing. Do I need an attorney when there is no money to even pay the balance of his arrangements? Please reply

Answer 2/2 - Submitted 12/13/2007

Hi Runner Guy, Yes, my Dad had a Will stating that all of his belongings go to me. I also had power of attorney when he was living. I am donating his clothing to Goodwill and other charities he liked. He has a bedroom set I am going to sell and and thats about it. I am keeping his car since it is paid for. I will file his taxes when that time comes. I am trying to find out in a case this simple if I need an attorney. He had no other children and I am the only living relative. He had an IRA for $15,000 that was payable to me on death and that check will be mailed in a week. He had a stock for $9,000 that I sold before he died knowing he would not make it. A few bucks in the checking account and I included the car in the $38,0000. It is hard enough loosing him but now dealing with all this makes it ten times worse. Any info is appreciated. His life ins. policy is only for $6,500. Thanks, Kelly
