Marriage If you and your husband have been married for 20 years and separated for 10 of the 20 years........But not legally and he has me on all of his life insurance policies.........and beneficiary of his 401k.........I have had the signed copies...........for 10 years..........He has other children from a perceives marriage.........If he dies who gets his money? Since I'm still legally his wife? Who gets his pension? He didn't sign his pension to me. I don't know how pensions go, with employers........If the pension goes to next of kin? Like Wife then children? Or doesn't no one get his pension? I have heard of some companies doing widows pensions? I sure his company has a thing were if one is still legally married, life insurance, 401k, and pension goes to his widow? Is these things right? In the state of N.C. |

If your husband dies with a will, heirs will be detrmined by that document only. If he dies intestate (without a will) the court will determine heirs and percentages. The most current documents, laws and company policies determine who receives any monies. The only thing you may get at age 62 is widow benefits from social security. If a court decides, generally the surviving wife gets 50% of the estate after debts are paid and the surviving children split the other 50%.

My mom out lived my dad by 25 years, She died recently august 6, 2010. They were separated 56 years. My Dad was a Veteran, Mom received all of his veteran benefits until death, and was buried in a military plot, even though they lived in different states. But was legally married, where she retained all the rights as his legal wife.
