If your still married there is probably not much you can do. If you are divorced then you seek help from your divorce attorney and keep the stub of the 401K as proof.

Go to the bank and file a claim with them and show proof of deposit of your 401K loan but sometimes you can't get it back due to time constraints. Second, if you knew he had a judgment against him why didn't you drop him from the account or open up your own, which I suggest you do when you go to the bank tomorrow.

It sounds as though the person whom you have the joint account with has credit problems that indirectly effected you. What you can do is find out what agency it is and write and explain the situation to them and if that don't work then the person whom you have the account with owes you and get off the joint account with his or her? It wasn't a marital thing and he didn't tell me he had a judgement against him. Thanks for the advice. The letter thing isn't gonna work because I've already talked to them. I'm headed to the bank now with the proof of deposit from my 401K company.
