Question

Asked 5/27/2010

I became disabled during my 9 year marriage.

I became disabled receiving my SSD during my marriage. My rollover 401k money was wiped out for expenses and to pay off a new camper trailer my husband wanted to purchase last summer and wants to keep after divorce. By the way I am his fourth wife.

Will the fact that I am disabled receiving 1/4 of his annual salary from my SSD work in my favor relative to amount and length of time of spousal I will receive? He has a masters while I have some college and can no longer work.

As in a regular divorce most property will be divided 50/50 but you husband may be held liable for spousal support. yes the amount odf dissability you receive will play a roll in the overall monetary compensation you recieve from spousal support. it should lesson it. get you a good lawyer and in most cases your husband will have to pay his fee's for you. I hope this helps.
