I am 51 years old and was laid off early 2010. I also opted to take retirement since I had the years in company. Can I get money from my 401K (NOT LOAN) but take a portion from it now?

Since you no longer work for that company, you can probably get a distribution from the 401(k). The plan might have some limitations about how much you can take (all or nothing, for example). Unfortunately, the distribution will also be subject to income tax and a 10% early distribution penalty because of your age.

If the plan requires you to take a complete distribution, you could take it out, use the amount that you need now, and roll the balance into an IRA. There are deadlines and possibly restrictions on how you do this, so you want to check with the plan administrator for advice.

If you can avoid taking money out of your 401(K) before that magic age of 59 and a half, you will be far better off. There are certain times when money can be taken out before that age, but depending on the plan, these are usually for proven financial hardships.

If you had been older than 55 at the time you lost your job and then retired, you might have been able to take the money without paying the 10% penalty, but as it stands, you are too young. No matter when you withdraw the money you would also be subject to income tax since taxes were deferred when you contributed to the 401(K).

If you are in a situation where taking out the money is critical, the penalties involved may not bother you, but leaving that money where it is can leave you a lot better off just a few years from now than if you subject it to the penalties of early withdrawal now.
