How much child support should my husband be paying his ex?

My husband give his ex everything when they got divorced. He give her half of his severance pay due to his place of employment closing, (reason for divorce he lost a good paying job) he give her all the equity when there house sold, he was required to give her half of his 401k but he give her all of it so she could pay cash for a new car and wouldn't have a payment. He lived in a camper for months after the divorce and made sure she got a new house and was set up for the kids and all he got was made fun of for living like a gypsy. We got married five yrs ago bought a trailer and moved to Mo. She moved to Mo after the divorce from Ar. This way he is close to the kids. He makes 9.50 per hr and pays her 400 a month thru the state for child support and he pays 62.50 a week for there health insurance and he has to reimburse her for co-pays and anything the insurance don't cover. She takes them to the dr all the time for stupid stuff. Last month he had to pay almost 100 to her for reimbursment. She threatens him with court if he don't pay with in 30 days the divorce decree says that . We have bills to. I work but I pay most of our bills so he can pay her. She went last yr and bought a new camero ss so I dought she is hurting for money. He is still paying for her old credit card he got stuck with in the divorce he pays almost 300 a month for that and has about 4yrs left on that. Just wondering is he paying enough or to much?

Wow! His ex-wife sounds like a real brat. If you don't mine me saying, he gave her way too much. She is using him and draining him financially.

In most divorces, the spouses are to share the expenses of the children. It sounds like this isn't happening. Now she's threatening to take him back to court? Let her. She'll have to pay the court costs, most likely. He can file a response to her petition and state that he is low income; that she is already getting this and that, and that he's already paying for all of the above.

The judge will take all of this into consideration and quite possibly adjust the child support. In addition, the judge may set out a totally new arrangement in his favor.

Also, here's a great website just for dads: http://www.dadsdivorce.com/articles/ask-a-divorce- lawyer-topics-for-ap ril-2-statute-of-limitations-on-alimony-divorced-a nd-living-together.h tml.

I suggest that you get a family law attorney. If you can't afford an attorney, try contacting Legal Aid in your city or state but to tell you the truth, if it were me, I'd wait and let her take me back to court. But that's me and not you and only you can make that decision.

I wish you the best outcome and thank you for visiting Webanswers.com.

Hi Camogirl,

It seems that your husband just wanted to be over this divorce and sort of agreed to anything and everything just to "settle" and be over with it. Alot of friends of mine and others I dont know do this ALL the time. NOT GOOD !

It seems that he is paying way to much and she is taking total advantage of him because SHE CAN....BECAUSE HE is LETTING HER ! The KEY is that he is letting her! STOP and STOP right now !

Yes, I am a woman and I am divorced but, the difference is that my Ex and I worked everything out fairly ...half and half and NEVER had a problem!

Call Legal Aid in your state and get a new court date. Go into court and ask for an amendment on your order and prove to the courts that she is really RIPPING you off ! He is absolutely being too nice and that is the problem....Tell him to step up and protect you and give her the FINAL boot ! She is a brat and totally taking advantage of him because HE IS LETTING HER !

Show him this answer....STOP IT NOW and take care of your caring wife and children and get rid of that USER NOW you are too good for her ! Good Luck...LOVE YOUR WIFE AND CHILDREN....finally ...kick her to the curb she will abuse yor relationship every minute she can....She is wrong AND MEAN !

HE should let HER take him back to court. The poor guy is being soaked dry.

The problem however, is that, since he's CAPABLE of making a lot more money, they take that into consideration. So, maybe he should start looking for a better job, or a 2nd job.
