Does an employee have a right to hold onto an employers 401k rollover request after the employee terminates his/her employee with the company I received, completed, and returned my 401K rollover paperwork to my ex employee and over 6 weeks has gone by and the rollover is still not complete. The employer is holding the paperwork. Is this legal and is there a time frame as to when the paperwork must be turned in? |

Is it legal for a company to hold and freeze a former employee’s 401k for 60 days? the employee was laid off due to the down turn in the construction industry and at no fault of the employee.
I have been advised that a new law is allowing employers the right to set up employees onto a 401k plan without direct written or electronic permission from the employee.
My company matches employee 401k contibutions in a lump sum for an entire year. that match is in the 1st quarter of the year that follows the "contribution year". if i am an employee of record for the entire "contribution year", but leave the company before the match is executed...
