My prevoius employer removed money from my 401k account, is this legal ?

My previous employer removed one third of the money from my 401k account (i did not roll over to my new employer), and returned this money to me. deducting the penalty from it. without any prior notice, is this legal ? i thought that money belongs to me. all the money was in the money market account...

Wanting to withdraw from 401k while laid off,x-employer says i must terminate to do so.

All contributions to the 401k are my own. the employer matched nothing, nor did they contribute anything to the 401k. is this legal, how can this be possible, it is my money. they are essentially, trying to break the union, holding this over are heads ,to give up call back rights.
