The purpose of a 401K Plan is to invest for retirement with tax benefits during the accumulation period as part of your employment benefits. Therefore, (1) if the employer is using your ITIN as part of the pay roll process and (2) the investment vehicle allows for the use of the ITIN to open an account then, YES.

My husband worked at a company for 10 years we did our taxes each year with our itin number he saved up those 10 years to his 401k. now i dont know how to claim it or if i can claim the money in my 401k with no social security number just my itin . is it possible?
