Can I take a loan from my 401K for hardship reasons? If yes, what is the re-payment schedule for a $5000 loan? |

I'm 100% vested , with the same company for 12 years, good credit, never borrowed before. i do have 20k in debts though.
My 401k company is advising that because i have a loan outstanding that i cannot request a hardship even though the loan amount is less than the amount of the overall balance that is in my 401k. is that legal?
What are the options without being penalized? we are wanting to take out $5,000 from a $90,000+ 401k balance as a hardship loan that we want to pay back. we do not want to just make a withdrawal. this is a medical emergency. any assistance you can offer would be greatly appreciated. thank you. cheryl
