Can I convert a 401K loan to a withdrawl?

I took loan out of my 401k due to a divorce to pay attorney fees and mortgage payments my now ex refused to contribute to. the monthly deductions to pay the loan back are putting a burden on me at this point, and I could really use the extra monthly income. I am not in a "hardship" ie lost job, losing home, etc...but have very little money left at the end of the month and it is stressful.....is there anyway I could request that it be converted to just a withdrawl and pay the penalty (which would be about = to what I would pay in 4 months of payments vs paying the payments for 4 more years)

The only one that can determine that would be the plan's administrator to see if the plan's langauge allows for that type of transaction.

I work in the 401K area. Generally, the plan description does not cover this topic. The answer is no. It will happen if you are terminated from employment.

Also, this is not a good idear financially. You should try to caut back or find an other sources.

Let me just put this on the table since we're on the topic. Never, ever borrow from your retirement savings for any reason. If finances in your life are such that its difficult to make ends meet and pay for basic things, then it is time to reevaluate your spending habits and your earnings power, and make choices and decisions that will help you to live more comfortably financially. Consider this; if you think its tough to make ends meet when you are working, when you reach the retirement years and are not AS able and capable of working, and you've gone through retirement savings, how do you expect it will be easier later on?

The future starts today. Don't let yourself walk into tomorrow with nothing to show for it.

As long as you are still employed, the loan payments must continue as you agreed. Loans will become withdrawal at termination or retirement if they are not paid in full but you cannot default on the agreement previously made. Some plans allow for another loan, to pay off the first, spreading the remaining payments over a longer period, some will even allow reamortization.. (not many) this is just prolonging the agony however. Deductions must continue as long as you are an active employee.
