Can a non-custodial parent contribue to his 401K plan if he is not meeting his child support order obligation? My ex is contributing large amounts of his income to his 401K plan and he is not paying what the court order states and is behind on child support payments. Is he allowed to contribute to the 401K if he not meeting his court ordered obligation child support payment? |

Yes he can contribue to his 401K, what they take is before taxes. But you can check with the child support services, they can enforce child support, and I do no that a 401K can be garnished for back child support, so it might be in your best interest to call the child support services and make them aware he has a 401K. I don't make the laws, I do agree with you but there is nothing that can be done. Actually I would think that you would be happy to no this, since his 401K can get you back your child support. Anyways get in contact with the child support services and talk to them and give them this information about his 401K. Good luck!
