Advice from different perspectives.

The mother of my children decided to move in with her sister in another county over 300 miles away after we seperated. My 2 boys are very young 3 and 1. She took off with my boys with her mothers help one day while I was working. She did not discuss this with me or try to compromise at all. I was just as involved in every aspect of their lives as she was, as was my mother. After trying to reason with her and reconcile for almost a month she revealed that she had filed for child support. It took me a small amount of time but I did hire an attorney as well as a private investigator to locate and serve her. She has been located however the apartment management is not co-operating nor are they answering the door. The p.i. is working hand in hand with my attorney and I have been informed that they will take steps to overcome these obstacles. In the meantime days are turning into weeks, weeks into months. I have refrained from trying to contact her or her mother due to the fact I either dont get an answer or I get an irrational tyrade. Her initial reasoning for keeping them from me was because she was waiting for a court date, now that I have hired a lawyer she has told me she was going to try and keep the kids from me and my mother permanately. I have obviously taken the neccessary steps to get this ridiculous situation resolved. Is there ANYTHING else I could be doing or try to do besides just waiting, no disrespect to those in more dire situations. Thank you.

More dire - are you kidding? You had your children taken away from you! That is a very dire situation.

I'm so sorry to hear. Have you tried to serve her at her place of work? Sometimes if people know they would be served at work, they will cooperate more to save the embarrassment. Have you seen if you can serve the papers via certified mail? That way, the post office will go there day after day until the papers are signed by someone over 18. Then you get a receipt that the papers have been received and if she doesn't show up at court still, pretending she didn't get the papers and you have proof that they were received at the house then the judge will rule in your favor.

Good luck - and take comfort in knowing that she cannot take our children away from you and since she moved in the manner that she did, the judge could ask her to take responsibility for transporting the children to and from visitation.

Yea this is dire. Ive just heard so many stories, especially guys not seeing their kids for years. I cant believe this situation has come to this. Anyway the P.I. has requested a 106 citation that would be served to a family member, they in turn would be responsible for notifying her. Dont know where shes working and shes now staying with someone else. Shes really trying to be as cruel as possible. Were here in Texas. All i can do is wait, my mother fears that she will go even further to keep the kids from us. What should i expect in family court, and what else can i do to prepare myself?
