401k info Is it illegal for my former employer to withhold my 401k information? if so, what do i do? |

It would be illegal for your employer to withhold your 401(k) information from you if you are participating or have participated in the employer's 401(k) plan. The law allows you to be granted access to the Summary Plan Description, trust agreement, and 5500 upon request, as well as your account statements at least annually. If your employer is not cooperating and giving you this information you can contact the United States Department of Labor (DOL) and they may be able to help you further. The DOL oversees employer sponsered retirement plans (i.e. 401(k) plans). The DOL's contact informaiton can be found on the web at www.dol.gov.
