401k beneficiaries

My wife is the beneficiary of my 401k. no tax event when I die? My son will become the beneficiary of the 401k then. When my wife dies, do the proceeds go thru probate? Or does he get a check less income tax?

If it is under 1Million, taxes won't be a concern. If you have a will he won't have to go through probate. Make sure it is up to date naming your wife and your son if she passes away.

Can a nonspouse beneficiary rollover an inherited 401k from a person who died in 2005?

2006 pension protection act allowed nonspouse beneficiaries to rollover 401k if the plan allowed. 2008 (?) congress amended the act to all 401k plans. i previously heard that the law was only effective for beneficiaries of a person who died in 2006 & after. what is the rule and are there other limitations?
