Asked 9/27/2008

4 beneficiaries, older is executor and money hungry.

The younger sister and husband got a little more, they took care of mom last few years of her life. she deaserved what my mom left her. the younger one did everything from medical to paying off everything after death. the older sister got mad about outcome of money. we are talking around a couple of hundred differance. Now executor after mom dieing Dec 30 07 has a lawyer filling out app to probate the will. Send us paperwork to sign. Im not signing nothing. Younger sister an her family deserve it all. All thats really left is 401k. To hire probate lawyer dont we all have to agree since we all are beneficiaries. Who pays for this guy since really almost everything was distributed.

You don't all have to agree. The person who hired him can pay the fee, or most often, the executor deducts his fee (a percentage of the estate) from the estate and what is left over is distributed amongst the heirs. Your not signing anything will only delay the process longer than necessary and prevent other heirs from getting paid. You can get your own attorney to ask questions if you have any, but sign so that the process will not be held up. If you don't want your share, take your check, cash it in and give the money to the youngest sister.
