401k retirement accounts are managed by the company you obtained the account from. 401k accounts are not managed by the federal government.

The Internal Revenue Service will be slightly involved in a 401k account but not from a management perspective. Since the money, going into a 401k account, is taken from your paycheck pre tax they will document that money. This is why you usually have to make note of how much money you’re contributing to your 401k account on your taxes. They want to make sure that the money they are not getting a piece of is going to a proper retirement account.

If you are having problems with the company who manages your employer’s 401k account try talking to someone in your companies’ human resources department. They should be able to assist you in addressing the issues you are having.
