My employer's 401k plan matches contribution for all employees BUT excludes one dept. team. Is that legal? Employer's 401k plan offers contributions to all employees that enroll in the plan and contribute to it. However, this 401k model is different for an specific departamental team where this selected group of people can enroll in the 401k plan but does not get the benefit of the company's contribution.

I would like to know how long an employer can legally take to make the employer's matching contribution to a 401k plan for the previous year. all of the employee contributions were made on a regular basis, but none of the employer matching contributions for 2011 have been made. company is experiencing...
