If I am currently in Bankruptcy, can I start 401K? My Husband and I have been in Bankruptcy for 1 year and 4 months. We are not currently in a 401K program. If we do decide to enroll in 401K, will this bankruptcy affect the 401K? |

No Bankruptcy does not affect your 401K. Everyone has a right to save for their retirement and the money you put away cannot be touched for the bankruptcy or if you had a judgement against you. Depending on how the banruptcy goes and how much you have to pay back you may or may have much money available to you for investment.
