Do you have to be a us citizen to be able to participate in a 401k program? If you are currenlty working in the US under a valid employment authorization can you participate in the 401k program offered by your employer? I say yes, but there is a rumor going around that you can't. I want to double check. |

My wife is a us citizen. i am not, i have a green card. if i die with her as my beneficiary, i've been told that because i'm not a us citizen, the government takes 50% of my 401k funds and she will get 50%. is there any truth to this?
