Asked 12/1/2008

Can I cancel my 401(k) and cash it out while still working for my employer?

Due to the current economic situation I need to get some funds from my 401(k) but do not qualify under the "hardship" areas. Can I just cancel my account and cash it out or am I stuck in a losing battle?

You should be able to cash it out but will probably have to pay the 10% penalty.

Besides the 10% penalty you also have to pay state and federal taxes depending of the state you live in.
